Pekas Smith Identifies Key Differences in SSDI Work Rules Across the SSA Application and Approval Process

Phoenix, Arizona, October 14, 2026: People receiving Social Security Disability Insurance (SSDI) may retain the ability to work while collecting benefits, though the impact of that work activity depends on where a claimant stands in the Social Security Administration (SSA) process and how the agency assesses their earnings.
The SSA uses a standard known as Substantial Gainful Activity (SGA) to determine whether a person's work activity is consistent with disability eligibility. SGA rules typically apply during the application stage. Once benefits are approved, a separate set of work incentives governs employment activity, including the Trial Work Period and the Extended Period of Eligibility, each of which can affect how a claimant's benefits respond to earned income.
"People receiving SSDI should understand that working does not follow one universal income rule. The effect of employment depends on whether someone is applying for benefits, using a Trial Work Period, or subject to the rules that apply after that period. Reviewing those distinctions before returning to work can help claimants make informed decisions about their benefits," said Jeremy D. Pekas, Founding Partner at Pekas Smith.
The Trial Work Period and the SGA standard are distinct concepts. The Trial Work Period permits an approved SSDI recipient to test their capacity to work under a specific set of SSA rules, without immediately losing benefits. Once that period concludes, the Extended Period of Eligibility comes into effect, under which SSDI payability in any given month is determined by the claimant's earnings alongside other applicable requirements.
Claimants who are considering returning to work are advised to track wages, self-employment income, and any qualifying work-related expenses, report all work activity to the SSA as required, and retain pay stubs and employment records. Because the SSA evaluates individual circumstances on a case-by-case basis, a general earnings figure does not determine the outcome for every claimant.
