NYC Law Firm Wins $1.9M Slip-and-Fall Settlement for Catastrophic Injuries

David Resnick & Associates, P.C., a New York personal injury law firm, has secured a $1,925,000 settlement for a 38-year-old woman who suffered catastrophic injuries after slipping and falling on a wet staircase in her building. The settlement, obtained by attorney Philip Monier, was reached before trial in the Supreme Court of New York County. The woman’s injuries included labral tears in both hips, as well as spinal and neck injuries, which required surgery and months of rehabilitation. The fall also induced labor, adding to her trauma.

The slip-and-fall lawsuit alleged that the building owner and managing agent failed to maintain safe conditions, despite ongoing snow and precipitation. The defense argued they were not required to continuously remove moisture or cover all floors with mats, and claimed lack of notice. However, Monier was prepared to present medical and economic experts to demonstrate the extent of the woman’s injuries and their long-term impact on her life, including limitations on walking, bending, sitting, and performing daily activities.

“When an accident happens as a result of someone’s negligence... the injured party deserves to be fully compensated,” Monier stated.
